EMPOWERD ACADEMY TERMS & CONDITIONS AND SERVICE AGREEMENT

By completing enrollment or accessing any course or program, you confirm that you have read, understood, and agreed to all terms set forth in this Agreement. Your electronic acceptance constitutes a valid signature under the federal E-SIGN Act (15 U.S.C. § 7001 et seq.).

1. ACCEPTANCE OF TERMS

By accessing or using the Empowerd Academy website, programs, courses, or educational materials — or by checking the acknowledgment box during checkout — you agree to be bound by this Terms & Conditions and Service Agreement. If you do not agree with these terms, please discontinue use of the website and services and do not complete enrollment.

1. ELIGIBILITY

To participate in Empowerd Academy programs, you represent and warrant that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, will provide accurate and complete registration information, will maintain the confidentiality of your login credentials, and will use the platform only for lawful purposes.

1. EDUCATIONAL PURPOSE ONLY

Empowerd Academy provides educational training and professional development resources related to peptides, health optimization, and related scientific subjects. All content is intended solely for educational and informational purposes. Nothing contained in our courses, website, or materials should be interpreted as medical advice, diagnosis, treatment recommendations, prescribing guidance, or individualized healthcare advice. Participation in our programs does not establish a medical provider-patient relationship. Individuals should consult qualified healthcare professionals before making any decisions regarding health or medical treatments.

1. PAYMENT, ACCESS & REFUND POLICY

4.1 Payment & Access Access to courses and programs is granted upon successful enrollment and payment where applicable. Payments are processed securely through third-party payment processors including Stripe and PayPal. By enrolling, you authorize Empowerd Academy to charge the applicable fees to your selected payment method.

4.2 Subscription & Auto-Renewal If you enroll in a subscription-based program, your subscription will automatically renew at the end of each billing period at the then-current rate unless you cancel prior to the renewal date. You may cancel at any time through your account dashboard or by contacting support@empowerdlife.com.

4.3 Refund Policy You have seven (7) calendar days from the date of purchase to request a full refund, provided that you have completed no more than 25% of the course or program content. If you have completed more than 25% of the course content, you are no longer eligible for a refund regardless of whether the 7-day window has elapsed. Refund requests must be submitted in writing to support@empowerdlife.com and include your full name, order confirmation number, and reason for the request. Approved refunds will be processed to the original payment method within 5-10 business days. Refunds will not be issued for failure to use course materials, dissatisfaction with educational outcomes, or violations of these Terms that result in account termination.

4.4 Chargebacks If you initiate a chargeback or payment dispute without first seeking resolution through our refund process, Empowerd Academy reserves the right to immediately suspend or terminate your account and pursue collection of amounts owed.

1. INTELLECTUAL PROPERTY & USE LICENSE

All content provided through Empowerd Academy — including course materials, videos, graphics, written content, downloads, frameworks, and logos — is the exclusive intellectual property of Empowerd Academy and is protected under applicable copyright and intellectual property laws. A limited, non-transferable, non-exclusive license is granted to you to access and view course materials for personal, non-commercial use only. You may not reproduce, distribute, resell, modify, or share access to any materials. This license terminates automatically upon any violation of these terms or termination of your account.

1. RESEARCH USE ONLY (RUO) DISCLAIMER

Certain educational materials may reference peptides, biochemical compounds, or emerging scientific research topics. These discussions are provided strictly for scientific literacy, academic discussion, and professional education. Some compounds referenced may be designated as Research Use Only (RUO). RUO compounds are not approved by the FDA for human consumption unless explicitly stated otherwise and are intended for laboratory research purposes only. Empowerd Academy does not manufacture, distribute, sell, or encourage the purchase of research compounds. Participants are solely responsible for complying with all laws and regulations applicable in their jurisdiction.

1. CLINICAL EDUCATION DISCLAIMER

Empowerd Academy provides continuing education and professional training related to emerging scientific and clinical topics. Educational materials may include discussions of published research, experimental therapies, emerging medical science, clinical case studies, and theoretical protocols for educational and academic purposes only. Educational materials may reference off-label uses or investigational therapies that have not yet received regulatory approval, which is common within medical education environments. Empowerd Academy does not recommend or endorse specific treatment protocols. Healthcare professionals remain solely responsible for clinical decision-making, patient care, compliance with regulatory guidelines, and adherence to professional licensure standards.

1. FTC COMPLIANCE & AFFILIATE DISCLOSURE

In accordance with FTC guidelines, some content may include testimonials, case studies, example outcomes, product discussions, or affiliate links. Testimonials represent individual experiences and are not guarantees of outcomes. Results may vary depending on professional background, implementation, individual health status, and external circumstances. When affiliate links are used, Empowerd Academy may receive a commission. We only recommend products or services we believe may provide value to our audience.

1. PRIVACY & DATA USE

Empowerd Academy respects your right to privacy. By using our platform, you consent to the collection and use of your information as described in our Privacy Policy, available at https://academy.empowerdlife.com. We do not sell your personal data to third parties. Information collected is used solely for account management, course delivery, communications, and platform improvement.

1. USER CONDUCT & RESPONSIBILITIES

By using the Empowerd Academy platform, you agree to provide accurate registration information, maintain the security of your account credentials, use the platform only for lawful non-commercial purposes, respect intellectual property rights, not engage in conduct that disrupts the platform, and not attempt unauthorized access. Violation of these responsibilities may result in immediate suspension or termination of access without refund.

1. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Empowerd Academy and its affiliates, officers, instructors, and partners shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from use of or inability to use educational materials, reliance on course content, website interruptions, third-party services, or misuse of course content. Participation is voluntary and undertaken at your own risk. In no event shall Empowerd Academy's aggregate liability exceed the total fees paid by you in the twelve (12) months preceding the claim.

1. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Empowerd Academy and its affiliates, officers, directors, employees, and partners from and against any claims, liabilities, damages, losses, and expenses — including reasonable attorneys' fees — arising out of your access to or use of our platform, your violation of this Agreement, or your infringement of any third-party rights.

1. MODIFICATIONS TO SERVICE & TERMS

Empowerd Academy reserves the right to modify or discontinue the service at any time with or without notice. Empowerd Academy may revise these Terms at any time. The most current version will be posted at https://academy.empowerdlife.com. Your continued use of the platform following any changes constitutes acceptance of those changes.

1. DISPUTE RESOLUTION & ARBITRATION

Before initiating any formal legal proceeding, you agree to first contact support@empowerdlife.com with a written description of the dispute. If not resolved informally within thirty (30) days, any dispute arising out of or relating to this Agreement shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules in the State of Colorado. YOU AND EMPOWERD ACADEMY AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION. This Agreement is governed by the laws of the State of Colorado.

1. GENERAL PROVISIONS

This Agreement constitutes the entire agreement between you and Empowerd Academy. If any provision is found unenforceable, the remaining provisions continue in full force. Empowerd Academy's failure to enforce any provision shall not constitute a waiver of that right.

By consenting to Empowerd Academy's SMS/text messaging service, you agree to receive recurring SMS/text messages through your wireless provider. Your consent is not a condition of any purchase.
